Velasquez found guilty, hunting incident occurred in two counties

A 27-year-old Prospect man who police say shot at a deer from the roadway — leading to a pursuit and gunfire through Buckingham and Cumberland — has been found guilty of three misdemeanor charges connected to the incident.

According to Buckingham County General District Court Clerk’s Office, Darwin Velasquez was found guilty in mid-February of shooting from a vehicle, trespassing and driving with a revoked license. He was not prosecuted on an assault charge.

Velasquez was sentenced with probation, fines and court costs.

Grand juries in Buckingham and Cumberland are set to consider charges against 51-year-old Kenneth Mount, of Dillwyn, who police say chased Velasquez from the scene shooting at his vehicle several times for several miles through Buckingham and Cumberland counties on Dec. 2.

Mount is charged with two counts of shooting into an occupied vehicle, discharging a firearm while in a motor vehicle and reckless driving, according to Virginia Department of Game and Inland Fisheries (DGIF) spokesman Lee Walker.

Court records show that a charge of damaging property was dismissed.

According to Walker, Velasquez shot at a deer from the roadway. Walker said the deer was standing in proximity to Mount’s son.

“The subject that fired the shot from the road then drives off and leaves the scene. He then returns later with his brother to look for the deer. The hunter on the private property calls his father, who is the landowner. The landowner and his son go to the road where the shot came from to investigate,” Walker said.

Walker said once Velasquez returned to the scene, “an altercation occurred between the landowner and the individual who appears to have fired the shot at the deer.”

Mount allegedly retrieved a rifle from his vehicle and displayed it, Walker said.

“The landowner pursues the vehicle through Buckingham and Cumberland counties. The landowner appears to have fired one shot that struck the back window of the fleeing vehicle, breaking the back window and then entering the interior … The landowner ends the pursuit just before entering the Farmville town limits and then turns around. The individual who shot the deer from the road called the police for assistance.”

A Buckingham grand jury is set to meet to consider the charges on April 12, while a Cumberland grand jury is set to meet April 26.
