The Cumberland County Planning Commission will meet on Monday, October 15, 2012, at 6:30 p.m., or as soon thereafter as may be heard, in Room C-8 of the Cumberland County Community Center located at the corner of Anderson Highway (Route 60) and Forest View Road (Route 628) in Cumberland, Virginia, to conduct a public hearing pursuant to Virginia Code Section 15.2-2204, which such hearing may be continued or adjourned, as required under applicable law, and to consider the following item and taking actions in furtherance thereof:

Code Amendment 12-02- Childcare centers and Auctions – Proposed Amendment to the Code of Cumberland County: The Cumberland County Planning Commission will review a proposal to recommend to the Board of Supervisors an amendment to the County Code entitled “An ordinance amending Chapter 74 Zoning of the Cumberland County Code..” The proposed amendment would amend the text of the zoning ordinance to allow childcare centers and auctions as a by-right use in the all of the County's Business zoning districts.

The public purpose of the proposed amendment is to allow auctions and childcare centers in all three of Cumberland's Business zoning districts. Currently childcare centers are permitted by-right in B-1 Business and require a conditional use permit in B-2 and B-3 Business. Currently the code is silent on auctions in the Business zoning districts. This amendment would increase the number of properties available for these uses in the County.

Copies of the complete text of the above proposed ordinance, resolution and associated documents are available for public review at the office of the Cumberland County Planning Department, County Administration Building, 1 Courthouse Circle, Cumberland, Virginia between 8:30 am and 4:30 pm of each business day. The public is invited to attend these hearings at which persons affected may appear and present their views orally or in writing. Questions or comments may be directed to Mr. Bret Schardein, Planning Director, at (804) 492-3520. Persons with disabilities are urged to contact the County Administrator's Office at (804) 492-3625 at least five (5) days prior to the meeting to arrange for any necessary accommodations.
