NOTICE OF SUBSTITUTE TRUSTEE'S SALE OF

In execution of a deed of trust from YVONNE JOHNSON BROWN and CLIFTON M. BROWN, dated April 26, 2002, in the original principal amount of $56,393.59, recorded in the Clerk's Office of the County of Buckingham, Virginia, in Deed Book 276, at page 575, (Seth E. Twery, P.C. having been appointed Substitute Trustee under instrument of record in said Clerk's Office in Deed Book 396, at page 232), due to default in payment of the debt secured, the undersigned Substitute Trustee will offer for sale at public auction in front of the Courthouse for the Circuit Court of Buckingham County, Virginia on the 6th day of September, 2012, at 10:00 a.m. that certain tract of real estate known as 181 Holman Lane, Dillwyn, Virginia 23936 situated in the County of Buckingham, Virginia:

All that certain tract or parcel of land together with the buildings and improvements thereon, lying and being in Curdsville Magisterial District, Buckingham County, Virginia, and containing 2.00 acres, as shown on that certain plat made by Maxey-Hines & Associates, P.C., dated February 18, 2002, and recorded in the Clerk's Office of the Circuit Court of Buckingham County, Virginia, in Deed Book 276, at Page 574. Said lands are shown on said Plat as being bounded on the northwesternmost boundary by the right of way to Virginia Secondary Route #623; on the northeasternmost boundary by lands of Holman; on the southeasternmost boundary by lands of Brown; and on the southwesternmost boundary by lands of Trenham. Reference to said plat is hereby expressly give for a more accurate and complete description of said property; and

Together with a non-exclusive perpetual right of way and easement twenty-five (25) feet wide for the purpose of ingress and egress in going to and from Virginia Secondary Highway No. 623 and said 2.00 acre parcel. Said right of way is approximately eight hundred fifteen (815) feet in length and is more clearly shown on the above described plat.

THIS SALE SHALL BE SUBJECT TO THE RIGHT OF REDEMPTION GRANTED TO THE SECRETARY OF THE TREASURY UNDER 26 U.S.C. 7425(d) AND SUBJECT TO ALL RESTRICTIONS, RIGHTS OF WAY, CONDITIONS, EASEMENTS, AND MECHANICS' AND MATERIALMEN'S LIENS, IF ANY, WHETHER OF RECORD OR NOT OF RECORD, TO THE EXTENT ANY OF THE FOREGOING APPLY AND TAKE PRIORITY OVER THE LIEN OF THE DEED OF TRUST.

Sale subject to all conditions, restrictions, reservations and easements, if any of record and now applicable thereto.
