Proposed new, amended ordinances

Citizens will have the opportunity Tuesday evening to give input to the Prince Edward County Board of Supervisors with regard to the potential adoption of an ordinance and the amendment of another.

At 7:30 p.m. in the Prince Edward County Courthouse, the board will hold two public hearings. One will pertain to the potential adoption of an ordinance establishing an electronic summons system and fee structure for the county. The other public hearing will pertain to proposed amendments to the county’s Sandy River Reservoir Ordinance.

The proposed amendment to the Prince Edward County Code with regard to an electronic summons system and fee structure would create Section 38-34 entitled, “Electronic summons system fee; amount; administration.”

The proposed ordinance reads as follows: “There is hereby imposed, in addition to any other fees prescribed by law, the sum of $5 in each criminal and traffic case in which the defendant is convicted of a violation of any statute of the commonwealth or any ordinance of the county filed in the general district court and the circuit court. The clerk of court in which the action is filed shall collect the assessment and remit it to the county treasurer. The county treasurer, subject to appropriation by the board of supervisors, shall disburse such funds in accordance with Section 17.1-279.1 of the Code of Virginia, 1950, as amended.”

The other public hearing will be for discussion of proposed changes to five parts of what is titled as “Ordinance to regulate and protect the Sandy River Reservoir and adjacent county-owned properties in accordance with Section 15.1-13 of the Code of Virginia, 1950, as amended.”

Under Section 82-31 of this ordinance, (a) reads as follows: “The following activities are hereby declared to be unlawful in that part of Lockett Magisterial District of Prince Edward County known as Sandy River Reservoir and on any county-owned property surrounding the reservoir.”

The first proposed amendment is to sub-point (2) under (a), the second of 21 sub-points citing unlawful activities. As it exists now, sub-point (2) reads as follows: “Parking on any county-owned property surrounding the reservoir other than in the Sandy River Reservoir Public Use Area located off Route 640, at the end of Route 792, or in any other area specifically designated by the Prince Edward County Board of Supervisors as a public parking area.”

With the proposed change, it would read like this: “Parking on any county-owned property surrounding the reservoir other than in the Sandy River Reservoir Public Use Area located at the end of Route 792, in designated parking areas at the end of Route 606 and Route 799, or in any other area specifically designated by the Prince Edward County Board of Supervisors as a public parking area.”

Sub-point (8) under (a) presently reads, “Operation in or on the reservoir of a windsurfer, sailboard or any wind-propelled vessel, other than a sailboat, length of which shall not exceed sixteen (16) feet.”

With the proposed change, it would read like this: “Operation in or on the reservoir of any wind-propelled vessel length of which exceeds sixteen (16) feet.”

Sub-point (18) under (a) presently reads, “Withdrawal of water for any purpose, with the exception that adjacent property owners with express written permission from Prince Edward County may withdraw reasonable amounts of water for irrigation and domestic purposes until such time as water therein is used for public water supply.”

With the proposed change, it would read like this: “Withdrawal of water for any purpose without express written permission from the Prince Edward County administrator.”

The fourth proposed amendment would be the addition of a sub-point (22) under (a) that reads as follows: “The launching of any watercraft, other than canoes, kayaks and small vessels without the use of a trailer entering the water, is prohibited at designated sites at the end of Route 799 and Route 606; watercraft may be launched by hand only at these designated sites. All watercraft to be launched by the use of a trailer entering the water shall use the concrete ramp at the end of Route 792.”

The final proposed amendment would be to (c) under Section 82-31 of this ordinance, which presently reads, “Except for those activities specifically authorized by the board of supervisors pursuant to Paragraph (b), any person who shall knowingly commit any of the acts declared unlawful in (a) above, as same is defined in Section 18.2-11 of the Code of Virginia, 1950, as amended.”

With the proposed change, it would read like this: “Except for those activities specifically authorized by the board of supervisors pursuant to Paragraph (b), any person who shall knowingly commit any of the acts declared unlawful in (a) above, shall be guilty of a Class 3 misdemeanor. A second violation of this section within three years is a Class 2 misdemeanor. A third violation of this section within three years is a Class 1 misdemeanor, as same is defined in Section 18.2-11 of the Code of Virginia, 1950, as amended.”

The public hearings will be held in the Board of Supervisors Room located on the third floor of the Prince Edward County Courthouse at 111 South St. in Farmville.
