In execution of a Deed of Trust in the original principal amount of $45,750.00 (with interest), from James E. Odum and Juanita W. Withrow, dated June 29, 2006 and recorded in the Clerk’s Office of the Circuit Court of the Prince Edward County, Virginia in Instrument No. 200601839; default having occurred in the payment of the Note thereby secured and at the request of the holder (RKL Mortgage Corporation – VA f/k/a SLM Mortgage Corporation – VA), of said Note, the undersigned Substitute Trustee will offer for sale at public auction at the entrance of the Circuit Court for the County of Prince Edward, Courthouse Building, 124 North Main St., Farmville, Virginia 23901, on November 23, 2015 at 1:00 o’clock p.m., the property briefly described in said deed, located at the above address and briefly described as:
ALL THAT CERTAIN TRACT, piece or parcel of land, situate, lying and being in the Leigh Magisterial District, Prince Edward County, Virginia, containing 2.00 acres, and known as a portion of Lot No. 7-B, Hatters Creek Estates, Section B, and shown on a plat of survey by Elisha E. Hodges, III, L.S. of Maxey –Hines & Associates, P.C., dated May 31, 2006, and recorded in the Clerk’s Office of the Circuit Court of Prince Edward County, Virginia, in Instrument No. 200601838. Reference is hereby made to said plat for a more particular metes and bounds description as contained in said plat. The description contained in said plat is incorporated herein by reference as if same were textually herein contained.
TOGETHER WITH and SUBJECT TO a perpetual right of way and easement sixty feet wide, over and across that certain area designated as “sixty foot access easement” as shown on that certain plat of survey by Ralph P. Hines, Surveyor-Engineer, revised January 15, 1982, and recorded in the Clerk’s Office of the Circuit Court of Prince Edward County, Virginia, in Plat Book 4, at page 148, for the purpose of ingress and egress in going to and from the above-described parcel and Virginia Secondary Highway No. 623. This conveyance is made subject to all easements, rights of way, and restrictive covenants now of record and affecting subject property.
