In execution of a certain deed of trust dated March 26, 2004, in the original principal amount of $45,426.44 recorded in the Clerk’s Office, Circuit Court for Buckingham County, Virginia, in Deed Book 300 Page 900, and modified on October 30, 2012, to decrease the principal balance to $41,168.19. This modification agreement was recorded in Deed Book 402, Page 333, the undersigned Substitute Trustee will offer for sale at public auction at the front steps of the building housing the Circuit Court for Buckingham County, Route 60, Courthouse Square, Buckingham, Virginia on October 21, 2015 at 2:00 pm the property described in said deed of trust, located at the above address and more particularly described as follows: THE FOLLOWING DESCRIBED PROPERTY, TO WIT: ALL THAT CERTAIN TRACT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON AND APPURTENANCES THEREUNTO BELONGING, SITUATED IN MAYSVILLE MAGISTERIAL DISTRICT OF BUCKINGHAM COUNTY, VIRGINIA, SAID LANDS FRONTING ON VIRGINIA SECONDARY ROUTE #617 AND BEING MORE PARTICULARLY DESCRIBED AS LOT 1 BY A PLAT OF SURVEY ENTITLED “ ROUTE 617 SUBDIVISION”, PREPARED BY ROBERT S. MAXEY, JR., L.S., DATED JULY 20, 1998, AND RECORDED IN THE CLERK’S OFFICE OF THE CIRCUIT COURT OF BUCKINGHAM IN PLAT CABINET A, AS A PART OF SLIDE 90 TO WHICH PLAT REFERENCE IS HEREBY MADE FOR A MORE COMPLETE AND ACCURATE DESCRIPTION OF THE LANDS HEREBY CONVEYED. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence.  If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
