In execution of a Deed of Trust dated February 19, 2008, recorded in the Clerk's Office, Circuit Court, Cumberland County, as Instrument Number 20080077, the undersigned will offer for sale at public auction the property described in and conveyed by said Deed of Trust, being known and designated as: ALL THAT certain lot, piece or parcel of land, with all improvements thereon and appurtenances thereto belonging, lying and being in the Hamilton Magisterial District of Cumberland County, Virginia, being known and designated as Lot 29, containing 2.00 acres, more or less, on a plat of Fairview Farms, made by Robert L. Lum, C.L.S., dated October 22, 1981, of record in the Clerk's Office, Circuit Court, Cumberland County, Virginia, in Plat Book 4, pages 90 and 91, to which reference is hereby made for a more particular description of the property..

Sale shall take place on October 18, 2012, at 2:00 p.m. at the front entrance of the Circuit Court building, Cumberland County, Virginia. Sale shall be subject to all matters of record lawfully affecting the title to the property. The property will be sold “as is” without any guaranty or representation as to condition or title and will be subject to such other terms and conditions as may be announced at the sale.

The successful bidder may be required to deposit 10% of the sale price in cash or by cashiers or certified check at the time his bid is accepted. Settlement in full shall take place within 10 days of sale and shall be in cash or by cashiers or certified check.
