TRUSTEE'S SALE

In execution of the Deed of Trust dated June 30, 2008, and recorded on July 1, 2008 as Instrument Number 200801740, of the Prince Edward County land records the undersigned Substitute Trustees, any of whom may act, will offer for sale at public auction on JUNE 7, 2012 at 12:00 p.m. at the front of the Courthouse of the Circuit Court for Prince Edward County, Main Street, Farmville, Virginia, the following property:

ALL THAT CERTAIN LOT or parcel of land, with improvements thereon and appurtenance thereunto belonging, situate, lying, and being in the Town of Farmville, Prince Edward County, Virginia, containing 0.274 acres, fronting on Woodland Trail and Roberts Street, and being more particularly described as Lot 18 as shown on a plat of Stonewood II, prepared by John M. Duggan, L.S., dated September 19, 2006, revised January 8, 2007, and April 2, 2007, and recorded in the Clerk's Office of the Circuit Court of Prince Edward County, Virginia, in Plat Cabinet A, Slide 347#6. Reference to said plat is hereby expressly given for a more accurate and complete description of said property.

The property and improvements will be sold in “as is” physical condition without warranty of any kind.

TERMS OF SALE: A non-refundable bidder's deposit of $20,500 by cashier's/certified check required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 14 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser's responsibility. Taxes pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit will be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney's fees of both sales. If Trustees do not convey title for any reason, purchaser's sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser's sole remedy shall be return of deposit without interest.
