TRUSTEE'S SALE OF VALUABLE REAL ESTATE

In execution of a Deed of Trust from E. G. Hall, Inc. dated March 13, 2008, and recorded in the Clerk's Office of the Buckingham County Virginia, in Book 357 page 276, default having occurred in the payment of the Note thereby secured and at the request of the secured party of said Note, the undersigned Substitute Trustee will offer for sale at public auction at the courthouse steps of the Buckingham County Circuit Court, in Buckingham, Virginia 22963, on February 28, 2012, at 11:00 a.m. the property described more fully in said Deed of Trust, commonly known as 27961 N. James Madison Hwy, New Canton, Virginia 23123, Tax Map #54-47 and more particularly described as follows:
All that certain tract or parcel of land with all improvements thereon and appurtenances thereunto belonging, lying and being in the Marshall District of Buckingham County, VA, containing 2.067 acres, more or less, said lands being more particularly described as to metes and bounds by Plat of Survey prepared by Timothy R. Miller, C.L.S., said plat being dated August 4, 2000, a copy of which is recorded in the Clerk's Office of the Circuit Court of Buckingham County, VA at Deed Book 258, page 435.
TERMS OF SALE: Cash. Bidder's deposit of ten percent (10%) of the successful bid in cash, cashier's or certified check at the time of auction, and balance upon tender of Special Warranty deed by the Substitute Trustee. Settlement within fifteen (15) days from the date of the auction; time is of the essence in closing. The Substitute Trustee reserves the rights: (l) to approve the credit worthiness of any bidder and final purchaser; (2) to reject all bids and withdraw the property from sale at any time prior to the termination of bidding; and (3) to keep the bidding open for any length of time. If the successful bidder fails to make final settlement within the time and according to the terms specified and the property is resold, the bidder's deposit shall be forfeited by the defaulting bidder, applied to the costs and expenses of such resale, any balance being retained by the Substitute Trustee as compensation for such sale. The sale and conveyance shall be subject to all matters of record, and the purchaser shall be responsible for any examination of title, etc. All acreage figures are estimates and not warranted. The property is sold “as is”. Additional terms of sale will be announced at the sale.
