In execution of a Deed of Trust dated April 12, 2007, recorded in the Clerk's Office, Circuit Court, Cumberland County, as Instrument Number 20007012, the undersigned will offer for sale at public auction the property described in and conveyed by said Deed of Trust, being known and designated as: ALL THAT certain lot, piece or parcel of land, with all improvements thereon and appurtenances thereto belonging, lying and being in Hamilton District, Cumberland County, Virginia, and containing 2.490 acres, more or less, as shown on plat entitled “COMPILED PLAT SHOWING a 2.490 ACRE PARCEL OF LAND, SITUATED ON THE SOUTHERN LINE OF U. S. ROUTE 60, IN THE HAMILTON DISTRICT OF CUMBERLAND COUNTY, VIRGINIA”, prepared by Potts, Minter and Associates, P.C., dated July 7, 2006, and recorded in the Clerk's Office of the Circuit Court of Cumberland County, Virginia, as recorded in the Clerk's Office of the Circuit Court of Cumberland County, Virginia, as Instrument No. 20062022. Reference is hereby made to said plat for a more particular description of the property. TOGETHER WITH an easement for ingress, egress and utilities 50' in width as shown on the above referenced plat.
Sale shall take place on February 24, 2011, at 1:30 p.m. at the front steps of the Circuit Court building, Cumberland County, Virginia. Sale shall be subject to all matters of record lawfully affecting the title to the property. The property will be sold “as is” without any guaranty or representation as to condition or title and will be subject to such other terms and conditions as may be announced at the sale.
The successful bidder may be required to deposit 10% of the sale price in cash or by cashiers or certified check at the time his bid is accepted. Settlement in full shall take place within 10 days of sale and shall be in cash or by cashiers or certified check.
