PURPOSE OF NOTICE: To seek public comment on a draft permit from the Department of Environmental Quality that will allow a surface water withdrawal in Buckingham County, Virginia.

PUBLIC COMMENT PERIOD: For 30 days, beginning on the day after the notice is published. The comment period will also be posted on DEQ's website.

PERMIT NAME: Virginia Water Protection Permit issued by DEQ, under the authority of the State Water Control Board.

NAME, ADDRESS AND PERMIT NUMBER OF APPLICANT: Buckingham County, P.O. Box 252, Buckingham, Virginia 23921. Virginia Water Protection Permit Number 09-1061.

PROJECT DESCRIPTION: Continuation of surface water withdrawals from the Troublesome Creek Reservoir not to exceed a maximum daily volume of 1.27 million gallons and a maximum annual volume of 311 million gallons under the minimum instream flow conditions and other provisions specified in the draft permit; permanent impacts to 818 linear feet of Troublesome Creek and unnamed tributaries, 0.51 acre of emergent wetlands and 2.53 acres of forest wetlands; and temporary impacts of 0.l4 acre of open water for the purposes of replacing the existing intake structure and modifying the existing overflow structure and spillway at the reservoir. Compensatory mitigation is proposed from one or more approved mitigation banks having a service area that includes the same or adjacent watershed as the proposed project. DEQ's preliminary decision is to approve the permit.

HOW TO COMMENT: DEQ accepts comments by email, fax or postal mail. All comments must be in writing and be received by DEQ during the comment period. Written comments must include 1) The name, mailing address, and telephone number of the person commenting and of all people represented by the citizen; 2) If a public hearing is requested, the reason for holding a hearing, including associated concerns; 3) a brief, informal statement regarding the extent of the interest of the person commenting, including how the operation of the facility or activity affects the citizen. DEQ may hold a public hearing, including another comment period, if public response is significant and there are substantial, disputed issues relevant to the proposed permit. The public may review the draft permit and application by appointment at the DEQ office named below.
