In execution of a certain deed of trust from Gertrude Johnson and Rufus Johnson to Mark C. Riley, Trustee, dated April 25, 2003, and recorded in the Clerk's Office of the Circuit Court of Prince Edward County, Virginia, as Instrument #200301150, securing a princi-pal amount of $30,400.00, de-fault having been made in the payment of the debt therein se-cured and being required to do so by the noteholder, the under-signed substitute trustee, ap-pointed by instrument of record in the Clerk's Office of the Cir-cuit Court of Prince Edward County, Virginia, recorded August 4, 2010 as Instrument # 201001298, will offer for sale at public auction the following:

Tract I:

ALL THAT CERTAIN lot or parcel of land consisting of five acres lying and being in Lockett Magisterial District, Prince Ed-ward County, Virginia, being located on the southern end of property now or formerly owned by John J. Madison, being bounded by the said John J. Madison on the North, Secon-dary Route 617 on the East, John Hamlin on the South and Lorene Row on the West.

ALL THAT CERTAIN lot or parcel of land lying about three miles southeast of Rice in Lock-ett Magisterial District, Prince Edward County, Virginia, con-taining One (1.0) acre and bounded on the East by Secon-dary Route 617, on the South by property now or formerly of Gertrude and Rufus Johnson, on the West by the property of Lorene Row, and on the North by John J. Madison.

THE ABOVE TWO PARCELS BEING in all respects the same real estate conveyed Gertrude Johnson and Rufus Johnson by deed dated December 10,2002, duly recorded in the Clerk's Of-fice of the Circuit Court of Prince Edward County, Virginia, as Instrument #200301149.

SALE TO BE HELD ON FRI-DAY, AUGUST 27, 2010, AT 11:00 A.M. ON THE FRONT STEPS OF THE COURTHOUSE OF THE CIRCUIT COURT OF PRINCE EDWARD COUNTY, 124 NORTH MAIN STREET, FARMVILLE, VIRGINIA, 23901.

TERMS OF SALE: Cash. Set-tlement within fifteen (15) days of sale, or as soon thereafter as a deed can be delivered. The property shall be sold “AS IS, WHERE IS” in its existing condi-tion without warranties of any kind or character as to its con-dition or the use to which it may be put. Conveyance of the real estate shall be by special war-ranty deed. Sale shall also be subject to any additional an-nouncements that may be made on the day of sale. A bidder's deposit of Ten (10) percent of the successful bid shall be re-quired.
