In execution of a Deed of Trust Modification dated February 1, 2009, recorded in Deed Book 369, Page 145, and modified by Second Modification Agreement of Deed of Trust and Note dated February 1, 2010, recorded in Deed Book 384, Page 270 in the Clerk's Office of the Circuit Court of Buckingham County, Virginia, default having been made in the payment of the indebtedness thereby secured, and having been directed by the holder of the note so to do, and after giving not less than fourteen (14) days due notice by certified mail to the owner of the real estate of the date, time, place and terms of sale, the undersigned Substitute Trustee (hereinafter Trustee), will on December 27, 2013, at 11:15 A.M. at the front door of the Buckingham County Circuit Courthouse, 13061 West Anderson Highway, Buckingham, Virginia 23921, offer for sale, at public auction, to the highest bidder, the property identified in the aforesaid deed of trust, situate and being in Buckingham County, Virginia, more particularly described as follows:

All those certain tracts or parcels of land, with improvements thereon and appurtenances thereunto belonging, situated in Marshall Magisterial District of Buckingham County, Virginia, containing in aggregate Fifty-Two and thirty-three/hundredths (52.33) acres, more or less, said lands fronting on Virginia Secondary Route #622 or Route #692 and being more particularly described as the aggregate of Lot 2 (25.00 ac.), Lot 3 (5.28 ac.), Lot 4 (6.00 ac.), Lot 5 (10.05 ac.) and Lot 6 (6.00 ac.) by a plat of survey of “Orchard Hill” Subdivision prepared by Todd M. Lenning, L.S., dated September 9, 2005, and recorded in the Clerk’s Office of the Circuit Court of Buckingham County in Plat Cabinet A, at slide 154D, to which plat reference is hereby made for a more complete and accurate description of said lands.

Said lands being the same conveyed unto Gatrap Investments, LLC a Maryland limited liability company, from South Coast Enterprises, Inc. a Virginia Corporation, by deed dated February 16, 2006, and recorded in the aforesaid Clerk’s Office in Deed Book 327, at page 625, et seq.

Reference is hereby made to the said deed, plat and other records in the aforesaid Clerk's Office for a more particular description of the property.

This sale and conveyance of the described property will be made and is subject to the covenants, dues or assessments, restrictions, rights-of-way, easements, and other matters, if any, contained in the deeds and other land records forming the chain of title to the described property and matters visible upon the premises.

This sale and conveyance is further subject to mechanic's (contractors and subcontractors) and materialmen's liens of record and not of record, if any such liens exist and any other matters of record taking priority over the Deed of Trust being executed and above described, and subject to real estate taxes for the following year(s): 2013, with the exception that taxes will be paid through the date of sale.

To the extent permissible by law, all bidders, including the successful bidder, waive and release the Trustee, the Note holder, and their respective agents, successors and assigns from any and all claims such bidder or his successor and assigns may have now or in the future relating to the environmental condition of the Property and all other actions arising from or relating to the condition of the Property including but not limited to any violation of federal, state and local laws, ordinances, or regulations affecting the use or condition of the Property.

The information as to the status of record title and improvements on the above-described real property and all documents available to the trustee may be examined by prospective purchasers at the Office of Howard Morrison Ross & Whelan, P.L.L.C. 31 Garrett Street, Warrenton, Virginia 20186, Monday through Friday between 9:00 a.m. and 5:00 p.m.
