TRUSTEE'S SALE OF TWO CONTIGUOUS PARCELS

In execution of a first lien deed of trust dated May 14, 2009, recorded in the Clerk's Office of the Circuit Court of Cumberland County, Virginia, as deed instrument number 20090582, the undersigned Sole Acting Trustee will offer for sale at public auction the following described real estate, to-wit:
PARCEL ONE (TM# 081-A-26A): All that certain tract or parcel of land located in the Randolph Magisterial District of Cumberland County, Virginia, containing 34.30 acres, and designated as Parcel 5 on a plat prepared by John R. Nunnally, Jr., Land Surveyor, dated October 19, 1984, a copy of which is of record in the Clerk's Office of the Circuit Court of Cumberland County, Virginia, in Plat Book 4, page 131.
Being the same lands conveyed to Robert B. Jackson and Doreatha M. Jackson, husband and wife, by deed of partition from Vivian Clark et als which is of record in said Clerk's Office in Deed Book 160, page 309.
PARCEL TWO (TM #81-A-26): All that certain tract or parcel of land located in Randolph Magisterial District of Cumberland County, Virginia, containing 34.28 acres, and designated as Parcel 4 on a plat prepared by John R. Nunnally, Jr., Land Surveyor, dated October 19, 1984, a copy of which is of record in the Clerk's Office of the Circuit Court of Cumberland County, Virginia, in Plat Book 4, page 131.
Being the same lands conveyed to Robert B. Jackson and Doreatha M. Jackson, husband and wife, by deed from Simuel A. Jackson et als which is of record in said Clerk's Office in Deed Book 196, page 382.
EXCLUDED PROPERTY: Any mobile home(s) on the subject real estate.
TIME AND PLACE: Wednesday, May 8, 2013 at 11:00 a.m. EDT at the front entrance of the Cumberland County Courthouse Building, in the Court House Square, 1 Courthouse Cir., Cumberland, Virginia.
CONDITIONS OF SALE: Sale subject to any and all easements, restrictions, conditions and reservations which are: contained in duly recorded deeds, plats, and other instruments constituting constructive notice in the chain of title to the property hereby conveyed that have not expired by limitation of time contained therein or have not otherwise become ineffective; or, apparent upon inspection of the premises. Sale also subject to any superior liens.
TERMS: 10% bidder's deposit, balance at closing. Closing to be within thirty (30) days from date of sale. Payment of both bidder's deposit and balance must be by cash, cashier's check or other check acceptable to Trustee.
