In execution of a certain deed of trust dated February 05, 2007, in the original principal amount of $135,000.00 recorded in the Clerk's Office, Circuit Court for Buckingham County, Virginia, in Deed Book 341 Page 803, default having occurred in the payment of the Note thereby secured and at the request of the holder, the undersigned Substitute Trustee will offer for sale at public auction at the front steps of the building housing the Circuit Court for Buckingham County, Route 60, Courthouse Square, Buckingham, Virginia, on February 27, 2013, at 10:00 AM, the property described in said deed of trust, located at the above address, and more particularly described as follows: LEGAL DESCRIPTIONS: ALL THAT CERTAIN PROPERTY SITUATED IN THE COUNTY OF BUCKINGHAM, AND STATE OF VIRGINIA, BEING DESCRIBED AS FOLLOWS: ALL THAT CERTAIN TRACT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON AND APPURENANCES THEREUNTO BELONGING, SITUATED IN JAMES RIVER HAGISTER(S) DISTRICT OF BUCKINGHAM COUNTY, VIRGINIA, CONTAINING TWO (2.0) ACRES, MORE OR LESS, BEING BOUNDED ON THE SOUTH BY THE NORTHERN MARGIN OF VIRGINIA SECONDARY ROUTE 607, ON THE NORTH BY THE OLD GREENWAY ROAD, AND ON THE EAST BY THE LANDS OF PERCY D. THE IMPROVEMENTS THEREON BEING COMMONLY KNOWN AS HC 02 BOX 120, BUCKINGHAM, VA 23921. TAX ID# 13525 BEING MORE FULLY DESCRIBED IN A DEED DATED 06-10-1987, AND RECORDED 6/9/1999, IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF THE COUNTY AND STATE SET FORTH ABOVE, IN DEED BOOK 185, PAGE 105..TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence.
