Notice of Auction Sale of Valuable Real Estate in Buckingham County

Pursuant to an Order of the Circuit Court for the County of Buckingham, Virginia, dated September 26, 2012, in the matter of Catlett v. Moniuszko et al, the undersigned Special Commissioner will offer for sale at public auction at the courthouse steps of the Buckingham County Circuit Court in Buckingham, Virginia on November 1, 2012 at 10:00 a.m. real property, a brief description of which is as follows:

All that certain lot, tract or parcel of land in the James River Magisterial District of Buckingham County, Virginia containing 90.6 acres, more or less, being bounded on the northernmost boundary by the lands now or formerly of Westvaco, on the easternmost boundary by the lands now or formerly of Kyanite, on the southernmost boundary by the lands now or formerly of Waltons Ford Branch and the lands now or formerly of Kyanite and on the westernmost boundary by the lands now or formerly of Glatfelter and known as Tax Map 77-1.

TERMS OF SALE: Cash. Bidder's deposit of ten percent (10%) of the successful bid in cash, cashier's or certified check at the time of auction, and balance upon tender of Special Warranty deed by the Special Commissioner. Settlement within fifteen (15) days from the date of Court approval; time is of the essence in closing. The Special Commissioner reserves the rights: (1) to approve the credit worthiness of any bidder and final purchaser; (2) to reject all bids and withdraw the property from sale at any time prior to the termination of bidding; and (3) to keep the bidding open for any length of time. Sale and final acceptance of successful bid is subject to and contingent upon Court approval. If the successful bidder fails to make final settlement within the time and according to the terms specified and the property is resold, the bidder's deposit shall be forfeited by the defaulting bidder, applied to the costs and expenses of such resale, any balance being retained by the Special Commissioner as compensation for such sale. The sale and conveyance shall be subject to all matters of record, and the purchaser shall be responsible for any examination of title, etc. All acreage figures are estimates and not warranted. The property is sold “as is”. Additional terms of sale will be announced at the sale
