In execution of a Deed of Trust in the original principal amount of $1,605,000.00, dated May 24, 2007recorded in the Clerk's Office of the Circuit Court of the County Of Prince Edward, Virginia, in Instrument 200701556, default having occurred in the payment of the Note thereby secured and at the request of the holder of said Note, the under signed Substitute Trustee will offer for sale at public auction at the entrance to the Circuit Court of Prince Edward County, Farmville, Virginia, on February 1, 2012 at 1:00 o'clock pm the property described in said deed, located at the above address and briefly described as:
PARCEL I: ALL those certain lots, pieces or parcels of land, with all improvements thereon and appurtenances thereto belonging, lying and being in the Town of Farmville, Prince Edward County, Virginia, all as shown on plat of survey made by R.C. Dodl, C.E., by plat dated February 9, 1972, and recorded March 28, 1973, in the Clerk's Office, Circuit Court, Prince Edward County, Virginia, in Plat Book 3, Page 47, entitled, “Plat of First National Bank Property, of corner of Third Street and Main in Town of Farmville”, AND as shown on plat of survey made by Maxey-Hines & Associates, P.C., dated July 1999, and recorded April 14, 2000, containing 0.435 acres, more or less, a copy of which plat is attached as “Exhibit A” to Deed recorded in Deed Book 344, Page 697, and to which plat reference is hereby made for a more particular description of the property hereby conveyed, with improvements thereon.
LESS AND EXCEPT that piece or parcel of land noted on Plat recorded in Plat Cabinet 3, Slide 47 entitled, “Baldwin Parcel” (as previously conveyed in Deed Book 140, Page 49), as more particularly shown and described on the aforesaid plat of survey.
PARCEL II: ALL that certain tract or parcel of land, situated in the Town of Farmville, Prince Edward County, Virginia, containing 2.478 acres, more or less, and more clearly shown as Parcel A on that certain plat of survey prepared by Ralph P. Hines, C.L.S., dated August 21, 1991, and recorded in the Clerk's Office of the Circuit Court of Prince Edward County, Virginia, in Deed Book 296, at Page 464. Reference is hereby made for a more particular metes and bound description as contained in said plat.
PARCEL III: ALL that certain lot, piece or parcel of land, with all improvements thereon and appurtenances thereto belonging, lying and being in Lockett District, Prince Edward County, Virginia, containing 38.60 acres, more or less, designated as Parcel 2 and being shown on a plat of survey entitled “Family Partition Plat”, dated December 28, 2005, revised January 2, 2006, and made by Watson and Duggan PLC, Land Surveyors, a copy of which is duly recorded in the Clerk's Office, Circuit Court, Prince Edward County, Virginia, in Plat Cabinet A, Slide 327, #1, and to which plat reference is hereby made for a more particular description of the property hereby conveyed, with improvements thereon.
TOGETHER with a non-exclusive right to the use and enjoyment of the 50 foot right of way and easement to be known as Gates Farm Lane and shown on the above referenced plat and within which is included an access road described in Deed Book 64, Page 121, but reserving unto the Grantors, their successors and assigns, the non-exclusive use and enjoyment of the 50 foot right of way and easement to be known as Gates Farm Lane located within the bounds of the 38.60 acre parcel of land described hereinabove.
BUT SUBJECT HOWEVER TO the reservation of a proposed 50 foot access easement from the western end of Gates Farm Lane and naming parallel to the western boundary of the parcel hereby conveyed to Parcel 3 shown on the above referenced plat, which said 50 foot access easement shall serve as ingress and egress for the benefit of Parcel 3 and its owners of record.
TERMS OF SALE: CASH: A deposit of $20,000.00, or 10% of the sales price, whichever is lower, cash or certified check, will be required at the time of sale with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser's sole remedy, in law or equity, shall be the return of his deposit without interest. Additional terms may be announced at the time of sale. Pursuant to the Federal Fair Debt Collection Practices Act, we advise you that this firm is a debt collector attempting to collect the indebtedness referred to herein and any information we obtain will be used for that purpose.
