The Cumberland County Planning Commission will meet on Monday, January 9, 2012, at 6:30 p.m., or as soon thereafter as may be heard, in Room C-8 of the Cumberland County Community Center located at the corner of Anderson Highway (Route 60) and Forest View Road (Route 628) in Cumberland, Virginia, to conduct a public hearing pursuant to Virginia Code Section 15.2-2204, which such hearing may be continued or adjourned, as required under applicable law, and to consider the following item and taking actions in furtherance thereof:

Code Amendment 11-08- Proposed Amendment to the Code of Cumberland County: The Cumberland County Planning Commission will review a proposal to recommend to the Board of Supervisors an amendment to the County Code entitled “An ordinance amending Chapters 6 Amusements and Entertainments and 74 Zoning of the Cumberland County Code..” The proposed amendment would (i) amend the sections of the Code that regulate festivals held within the County to provide for major and minor festivals and staff level approval for minor festivals and (ii) amend the text of the zoning ordinance to define and permit special events which would be by-right and certain special events that would be permitted only by conditional use permit in A-2, Agricultural and R-3 Rural Residential zoning districts.

The public purpose of the proposed amendments is to establish definitions for events of differing size, type and frequency rather than addressing all events under the same process. The amendment would permit some less intensive event types as a by-right use, while other more intensive festival or events would be permitted by receiving a festival or conditional use permit so that the demands to protect the public health, safety and welfare, including, needs at events such as food, water, sanitation, security and traffic can be adequately addressed.

Copies of the complete text of the above proposed ordinance, resolution and associated documents are available for public review at the office of the Cumberland County Planning Department, County Administration Building, 1 Courthouse Circle, Cumberland, Virginia between 8:30 am and 4:30 pm of each business day. The public is invited to attend these hearings at which persons affected may appear and present their views orally or in writing.
