In execution of a certain deed of trust dated October 24, 2000, in the original principal amount of $76,957.00 recorded in the Clerk's Office, Circuit Court for Buckingham County, Virginia, in Deed Book 258 Page 839, default having occurred in the payment of the Note thereby secured and at the request of the holder, the undersigned Substitute Trustee will offer for sale at public auction at the front steps of the building housing the Circuit Court for Buckingham County, Route 60, Courthouse Square, Buckingham, Virginia, on December 01, 2011, at 9:00 AM, the property described in said deed of trust, located at the above address, and more particularly described as follows: ALL OF THAT CERTAIN LOT OR PARCEL OF REAL ESTATE, TOGETHER WITH ANY IMPROVEMENTS THEREON AND PRIVILEGES AND APPURTENANCES THEREUNTO BELONGING, SITUATED IN THE CURDSVILLE MAGISTERIAL DISTRICT OF BUCKINGHAM COUNTY, VIRGINIA, FRONTING ON U.S. HIGHWAY 60, WHICH IS SHOWN AND DESCRIBED AS LOT A, CONTAINING 2.00 ACRES, MORE OR LESS, ON A PLAT OF SURVEY BY DONALD R. MAXEY, L.S., DATED AUGUST 18, 2000, A COPY OF WHICH PLAT OF SURVEY IS ATTACHED HERETO AND MADE A PART HEREOF. THE METES AND BOUNDS DESCRIPTION CONTAINED ON SAID PLAT OF SURVEY IS INCORPORATED INTO THIS INSTRUMENT AS IF FULLY WRITTEN OUT HEREIN. PLAT IN DEED BOOK 255 PAGE 98. THIS BEING A PORTION OF THE REAL ESTATE WHICH WAS CONVEYED TO ROBERT T. JOHANSEN AND LILLIAN M. JOHANSEN, HUSBAND AND WIFE, BY DEED DATED JANUARY 8, 1996, FROM HOWARD C. HOGG AND M. VICTORIA HOGG, WHICH DEED WAS RECORDED IN THE CLERK'S OFFICE FOR THE CIRCUIT COURT OF BUCKINGHAM COUNTY, VIRGINIA, IN DEED BOOK 207, AT PAGE 131..TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence.
