CUMBERLAND COUNTY BOARD OF ZONING APPEALS

The Cumberland County Board of Zoning Appeals will meet on Wednesday, June 8, 2011, at 7:00 p.m., or as soon thereafter as may be heard, in Room C-8 of the Cumberland County Community Center located at the corner of Anderson Highway (Route 60) and Forest View Road (Route 628) in Cumberland, Virginia, to conduct a meeting and a hearing pursuant to Virginia Code Section 15.2-2309(2), which such hearing may be continued or adjourned, as required under applicable law, and to consider the following item and taking actions in furtherance thereof:

BZA 11-02: David B. Brown (Electoral District 3) requests a variance from the requirements of Cumberland County Code Section 74-631 and, consistent with the provisions of Section 74-630 of the Zoning Ordinance, to allow for a pre-existing and non-conforming, free standing sign to be extended with respect to 4.280 acres of Tax Map 65, Insert A2, Section A, Parcel 22. The affected property is zoned R-2, Rural Residential and A-2, Agricultural.

The applicant requests a variance from: 1) the 100 foot setback required for freestanding signs from boundaries of residentially-zoned properties and 2) the 24 foot maximum square footage of sign area permitted for a freestanding sign in the R-2, Rural Residential Zoning District. The applicant proposes to add additional signage on top of the pre-existing sign. The additional proposed sign area would add 28 square feet to the existing 23 square feet of the existing sign area for a total of 51 square feet of sign area when only 24 square feet is permitted. The total road frontage for the parcel is 206 feet and the pre-existing sign is located approximately 50 feet from the residentially-zoned property boundary to the east. The distance of the sign from the western property boundary meets setback requirements. The affected property has a physical address of 1756 Anderson Highway, Cumberland, Virginia, 23040 and is located on the north side of Route 60 approximately 1 mile west of the intersection of Criss Road (Rt. 669) and Route 60. The affected property is not located within a growth area as designated by the Comprehensive Plan.
