TRUSTEE'S SALE

IN EXECUTION of Deed of Trust dated March 20, 2000, made by John Edwards and Eula Edwards, recorded in the County of Prince Edward Circuit Court Clerk's Office in Deed Book 0343 Page 027, securing Note in original principal amount of $57,562.13, default having been made in payment of debt thereby secured, and at request of beneficiary thereunder, the undersigned, will offer for sale at public auction to the highest bidder, for cash, at the front door of the County of Prince Edward Circuit Court, 111 South Street, Farmville, Virginia, on May 5, 2011 at 2:00 p.m., the properties conveyed in said Deed of Trust and briefly described as follows:

TRACT I:

ALL THAT certain lot or parcel of land, lying and being in Prospect Magisterial District, Prince Edward County, Virginia, beginning at an iron stake on the North side of the Norfolk and Western Railroad right of way where herein described property intersects the western line of Secondary Highway 763; thence along the western right of way of Secondary Highway 763, 167 feet to an iron rod on a driveway; thence in a westerly direction along said driveway 150 feet to an iron pin; thence in a southwesterly direction along other property of James C. Johnson, et ux, 79 feet to an iron stake on property of Fulcher; thence in a southwesterly direction 88 feet to an iron stake on the Norfolk and Western Railroad right of way; thence in an easterly direction along the Norfolk and Western right of way 188.89 feet to the point of beginning, together with all improvements thereon and appurtenances thereto attached and belonging.

TRACT II:

ALL THAT CERTAIN lot, piece or parcel of land, with the buildings and improvements thereon, situate, lying and being in the Village of Prospect, Prospect Magisterial District, Prince Edward County, Virginia, and bounded and described as follows: BEGINNING at a point where the Norfolk & Western Railway's right of way intersects with a private road leading to property now or formerly belonging to J. E. Glenn on the West side thereof; thence running in a Northerly direction a straight line on the Western side of the said private road 76 feet; thence in a perpendicular line to the last mentioned line in a Westerly direction 22 feet; thence in a perpendicular line to the last mentioned a distance of 76 feet to a point on the said railway right of way; thence along the said right of way to the point and beginning a distance of 22 feet.

TERMS OF SALE: CASH. Property is being sold “AS IS”, without any representations or warranties, SUBJECT to the rights of any person in possession and to all covenants, conditions, restrictions, easements, defects, encumbrances, adverse claims, or liens, whether filed or inchoate, which have priority over the Deed of Trust.

Deposit of 10% cash, certified or cashier's check, will be required of successful bidder immediately after sale; settlement must be within 10 days from date of sale, TIME BEING OF THE ESSENCE, or property to be resold at cost to defaulting purchaser, and Trustee shall be entitled to recover from defaulting purchaser any deficiency resulting from resale. All costs of conveyancing, examination of title, recording and settlement charges, grantor's taxes, etc. to be at cost of purchaser. Noteholder reserves the right to bid and trustee reserves right to reject any bids, keep bidding open for any length of time, waive deposit requirements, extend time for settlement, announce additional terms of sale and cancel or rescind sale solely at trustee's discretion.
