In execution of a first lien deed of trust dated April 7, 2004, recorded in the Clerk's Office of the Circuit Court of Buckingham County, Virginia, in Deed Book 371, Page 594, et seq., the undersigned Substitute Trustee will offer for sale at public auction the following described real estate, to-wit:

ALL that certain lot, tract or parcel of land laying and being in Slate River Magisterial District of Buckingham County, Virginia, bounded on the east by VSR #20, and containing three and two hundred twenty-four thousandths (3.224) acres, more or less. Said lands are more particularly described as Lot #5, on a plat of survey by Robert L. Lum, C.L.S., dated October 23, 1989, and titled “Midway Hills Subdivision.” Said plat is recorded in the Office of the Clerk of the Circuit Court of Buckingham County, Virginia, in Plat Book 2, at Page 100, et seq.

TIME AND PLACE: January 6, 2011, at 10:00 a.m., Court House Square, Rt. #60, Buckingham Courthouse, Virginia. In front of former main entrance to Courthouse Building.

CONDITIONS OF SALE: Sale subject to any and all easements, restrictions, conditions and reservations which are: contained in duly recorded deeds, plats, and other instruments constituting constructive notice in the chain of title to the property hereby conveyed that have not expired by limitation of tie contained therein or have not otherwise become ineffective; or, apparent upon inspection of the premises.

TERMS: 10% bidder's deposit, balance at closing. Closing to be within thirty (30) days from date of sale. Payment of both bidder's deposit and balance must be by cash or appropriate check.
