In execution of a Deed of Trust dated December 17, 1999, recorded in the Clerk's Office, Circuit Court, Cumberland County, in Deed Book 238 at page 190, the undersigned will offer for sale at public auction the property described in and conveyed by said Deed of Trust, being known and designated as:

ALL OF THAT certain lot or parcel of land, situate, lying and being in Randolph Magisterial District, Cumberland County, Virginia, being a part of Jackson Heights as shown on a plat of Sherman Clodfelter, C.E., recorded in the Clerk's Office of the Circuit Court of Cumberland County, Virginia, in Deed Book 63 at page 211; said lot is described as beginning at a point 245 feet 3 inches south of the intersection of Virginia and Madison Streets on the west side of Madison Street; thence at right angles with Madison Street N. 65 degrees 5' W. 150 feet to a point; thence S. 24 degrees 55' W. 54 feet 9 inches to a point; thence S. 65 degrees 5' E. 150 feet to Madison Street; thence N. 24 degrees 55' E. 54 feet 9 inches to the point of beginning.

Sale shall take place on December 2, 2010, at 1:00 p.m. at the front steps of the Circuit Court building, Cumberland County, Virginia. Sale shall be subject to all matters of record lawfully affecting the title to the property. The property will be sold “as is” without any guaranty or representation as to condition or title and will be subject to such other terms and conditions as may be announced at the sale.

The successful bidder may be required to deposit 10% of the sale price in cash or by cashiers or certified check at the time his bid is accepted. Settlement in full shall take place within 10 days of sale and shall be in cash or by cashiers or certified check.
