In execution of a DEED OF TRUST in the original principal amount of $262,600.00 from OLD VIRGINIA LAND COMPANY, RANDALL G. MOSS and RENEE MOSS, dated April 24, 2006, recorded in the Clerk's Office of the Circuit Court of Prince Edward County, Virginia as Instrument #200601137, the undersigned Trustee will offer for sale at public auction on Friday, December 17, 2010, at 11:00 o'clock a.m. in front of the Prince Edward County Courthouse, located at Courthouse Building, North Main Street, Farmville, Virginia, the property described in said instrument as:

All those certain lots or parcels of land situate and being in Leigh District, Prince Edward County, Virginia, designated and more particularly described as Lot 4 containing 17.55 acres, more or less, and Lot 5 containing 3.00 acres, more or less, as shown on that certain plat of survey entitled “Survey of Carter Tract Subdivision” made by Robert S. Maxey, Jr., L.S., dated August 1, 2006, which plat is of record in Clerk's Office of the Circuit Court of Prince Edward County, Virginia, with Instrument #200602447 in Plat Cabinet A, Slide 335 #4.

TERMS OF SALE: CASH. 10% deposit, cash or certified check, at time of sale and balance upon tender of special warranty deed. Settlement to be held within thirty (30) days from the date of sale. The Trustee reserves the right: (i) to waive the deposit requirement; (ii) to approve the credit worthiness of any bidder and final purchaser; (iii) to withdraw the Property from sale at any time prior to the termination of the bidding by the Trustee; and (iv) to keep the bidding open for any length of time. In the event of resale, the deposit shall be forfeited by the defaulting purchaser and applied to the costs and expenses of the sale, and the Trustee, as compensation for the sale, shall retain the balance, if any. Time shall be of the essence with respect to settlement. Additional terms may be announced at the time of sale. Purchaser pays all closing costs. Real estate taxes adjusted to the date of sale. The Property is sold “AS IS” without representation or warranty of any kind, and SUBJECT TO conditions, restrictions, covenants, rights of way, easements, and reservations, if any, contained in the deeds forming chain of title thereto, filed and unfiled mechanics' and materialmen's liens, if any, and all other matters of record taking priority over the Deed of Trust, if any. Trustee does not warrant or guarantee possession of the premises.
