   In execution of a Deed of Trust in the original principal amount of $69,000.00, dated June 12, 2003 recorded in the Clerk's Office of the Circuit Court of the County Of Prince Edward, Virginia, in Instrument 200302174, default having occurred in the payment of the Note thereby secured and at the request of the holder of said Note, the undersigned Substitute Trustee will offer for sale at public auction at the entrance to the Circuit Court of Prince Edward County, Farmville, Virginia, on March 15, 2010 at 3:00 o'clock pm the property described in said deed, located at the above address and briefly described as:
   Lot 73, Whisperwood, Section V, recorded in Plat Book 5, at Page 240. Together with a permanent and perpetual right-of-way for ingress and egress over and across the 50 ft. access right-of-way as shown on the aforementioned plat leading from Lot No. 73 to State Route No. 600 with said right-of-way running with the aforementioned lot, together with which was intended to become a part of realty, with improvements thereon.
   TERMS OF SALE: CASH: A deposit of $5,000.00, or 10% of the sales price, whichever is lower, cash or certified check, will be required at the time of sale with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser’s sole remedy, in law or equity, shall be the return of his deposit without interest. ORDER OF PUBLICATION

   The object of the above-styled suit is to have the court issue an order (1) adjudicating that partition of this real estate among the above-referenced parties entitled thereto cannot conveniently be made, that none of the interested parties is willing to buy and pay for the shares of the other parties and that the interests of the parties entitled to share in this real estate would be promoted by a sale thereof; (2) directing a sale of said parcel of real estate in such manner as to yield the best price and, directing that the net proceeds, after payment of the costs and expenses of the suit and sale, be divided among the parties according to their respective rights and interests; and (3) granting such other and any further relief as the nature of his case may require. Said real estate being described more clearly described as follows:
   ALL OF THAT CERTAIN TRACT or parcel of land, lying and being in the Prospect Magisterial District of Prince Edward County, Virginia containing 24 acres, more or less, and more particularly described by metes and bounds as follows: Beginning at a rock and running thence due south 95 poles to a pine, thence on public road S. 75 deg. W. 32 poles to post oak, thence N. 8 deg. W. 102 poles to a sassafras, thence due each 48 poles to rock, and adjoining the lands of now or formerly owned by Sara Jan Hix on the west, Thomas Haskins on the north, E. W. Tomlinson on the east and the main public road on the south.
   LESS AND ACCEPT: 3.25 acres as shown on plat of survey of Ralph P. Hines, C.L.S., dated October 8, 1986 and recorded with a deed of gift to Joe Newby and Bertha Newby, husband and wife, from Marie Davis, widow, Bertha Newby and Joe Newby, her husband, Thelma Dillard, single and Russell Davis. Said conveyance is re-corded in the Clerk’s Office, Circuit Court of Prince Edward County in Deed Book 240 at Page 868.
   LESS AND ACCEPT: 1.0 acre as shown on plat of survey of Ralph P. Hines, S.E., dated September 21, 1988 and recorded with a deed to Alice J. Shepperson, as feme sole, from Marie Davis, widow, Bertha M. Davis Newby and Jobe H. Newby, her husband; Russell E. Davis, divorced and Thelma O. Davis Dillard, Divorced, being widow and heirs of Walter Davis. Said conveyance is recorded in the Clerk’s Office, Circuit Court of Prince Edward County in Deed Book 267 at page 740.
   LESS AND ACCEPT: 1.0 acre as shown on plat of survey of Ralph P. Hines, S.E., dated November 22, 1988 and recorded with a deed to James Richard Ward from Marie Davis, widow, Bertha M. Davis Newby and John H. Newby, her husband; Russell E. Davis, divorced and Thelma O. Davis Dillard, Divorced, being widow and heirs of Walter Davis. Said conveyance is recorded in the Clerk’s Office, Circuit Court of Prince Edward County in Deed Book 247 at page 813.
   And, it appearing by affidavit filed according to law that the identity and/or location of some of the heirs, devisees, and/or successors in interest of Russell Edward Davis, Sr., are unknown, that they may be deceased, and that they may be outside the Commonwealth of Virginia, and it appearing by affidavit that Thelma O. Dillard resides outside of the Commonwealth of Virginia, it is therefore ORDERED that the heirs, devisees, and/or successors in interest of Russell Edward Davis, Sr., and Thelma O. Dillard, appear on or before the 5th day of April, 2010, in the Clerk’s Office of this Court and do what is necessary to protect their interests.
   And, it is further ORDERED that this order be published once a week for four (4) successive weeks in the Farmville Herald, a newspaper of general circulation in the County of Prince Edward, and that a copy of this order be posted at the front door of the courthouse wherein this court is held.
