Obituary
of

James McClellan,
1937-2005
Noted Scholar, Historian,
Dies Friday

James McClellan, a former high-ranking aide to Senators Orrin Hatch, Jesse Helms, and John East on the United States Senate Committee on the Judiciary, died Friday, January 28. 2005 at his home in Meherrin. He was 67 years old.
The cause of death was complications from pulmonary and heart disease.
McClellan was a noted legal scholar and constitutional historian and an expert on the political and legal thought of Justice Joseph Story. His Joseph Story and the American Constitution is a seminal study and a model of judicial intellectual biography. He was also the author of Liberty, Order. and Justice: An Introduction to the Constitutional Principles of American Government, and the co-editor of a widely regarded edition of The Federalist. At the time of his death he was working on a treatise on states' rights and the foundations of federalism.
In addition to his service to the judiciary committee, Dr. McClellan held academic appointments at the University of Alabama, Emory University, Hampden-Sydney College, and Claremont McKenna College. His last post was as the James Bryce Visiting Fellow at the Institute of United States Studies in the University of London, 1998-2003.
From 1993-1998 he served as Director of Publications and was a Senior Research Scholar at the Liberty Fund in Indianapolis.
From 1983 to 1993, he was the founding president of the Center for Judicial Studies, a non-profit educational organization devoted to the advanced study of the Constitution and the role of the judiciary. The center published books and monographs and conducted scholarly conferences and judicial seminars on the Constitution for state and federal judges, political scientists and historians, and high school civics teachers.
Dr. McClellan was also the editor of the center's journal, Benchmark, in which he honored those he believed were supporters of the Constitution, such as Judge Robert H. Bork and the late Raoul Berger, and skewered those whom he deemed dangers to it, such as Laurence Tribe of Harvard Law School, and President Ronald Reagan's first Solicitor General, Rex Lee. When it came to taking the Constitution seriously, and understanding what he saw as the proper and limited role of judges under it, McClellan never let his political predilections blind him. Republicans who would distort the Constitution's original meaning were no more acceptable to him than the Democrats who did so.
In 1985 he ran unsuccessfully for the House of Delegates (59th District) against W. M. Abbit, Jr. McClellan was the first Republican to run for this office in 50 years.
McClellan was also a committed conservative who was active in many organizations such as the Philadelphia Society, where he twice served on the board of trustees and one term as vice president. As a leading conservative intellectual, McClellan was especially generous to younger scholars whom he knew to be the future of the conservative movement. Many in the academic and political worlds today are in his debt for his unwavering support and encouragement.
James McClellan was born June 26, 1937. the son of James Charles McClellan and Florence Turner McClellan. He was a graduate of the University of Alabama and after service in the United States Marine Corps earned his doctoral and law degrees at the University of Virginia. James McClellan took great pride in being a son of the South, a part of the country he loved beyond measure.
Dr. McClellan is survived by his wife Martha (Molly) Synon McClellan; by three daughters, Susannah, Maggie, and Darby;and by three sons, Graham, Duncan, and Angus. A fourth son, Douglas, predeceased him. He is also survived by a brother, Gary McClellan, of Arizona, and a sister, Jane Boyce, of Pennsylvania.
Services will be held at Johns Memorial Episcopal Church in Farmville, on Thursday, February 3, at 1 p.m. with interment in Westview Cemetery.
Donations may be made to either Farmville-Prince Edward Historical Society. P.O. Box 546, Farmville, VA 23901 or Meherrin Rescue Squad.
Under the care and direction of Doyne-Burger-Davis Funeral Home, Farmville.
